Le Musica — Terms of Service (Malaysia)

Welcome to Le Musica (“Le Musica”, “we”, “us”, “our”). These Terms of Service (“Terms”) govern your access to and use of our website, online store, and related services, including orders placed via our site, messaging platforms (e.g., WhatsApp), phone, or in-store (collectively, the “Services”). By using the Services, you agree to be bound by these Terms and our Privacy Policy.

 

Changes to these Terms

We may update these Terms from time to time. The latest version will be posted on this page with the “Effective date”. Continued use of the Services after changes means you accept the updated Terms.

 

 Eligibility & account security

  • You must be at least 18 years old (or have parental consent) to place orders.
  • You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately if you suspect unauthorised access.

 

 Orders, pricing & payment

  • Placing orders. Your order is an offer to purchase; acceptance occurs when we issue an order confirmation or deliver the products. We may decline or cancel any order for reasons including stock limitations, pricing or description errors, suspicion of fraud, or regulatory issues.
  • Prices. All prices are in Malaysian Ringgit (“MYR”) and include/exclude SST as stated. We may correct typographical errors, inaccuracies, or omissions (including product descriptions, pricing, and availability) at any time without prior notice.
  • Payment methods. We accept the payment options shown at checkout or provided by our team (e.g., bank transfer, card, e‑wallets, or instalments where available). For bank transfers, please use the exact amount and include your order ID. We do not store full card data.
  • Instalments / BNPL. Where offered, instalment plans are provided by third‑party partners under their own terms. Approval is subject to the partner’s assessment.
  • Pre‑orders & special orders. Estimated arrival dates are guides only. If we cannot supply a pre‑order or special order within a reasonable time, we may cancel and refund you in full.
  • Tax invoices. A tax invoice/receipt will be provided upon successful payment.

 

Delivery, installation & self‑collection

  • Coverage & fees (pianos). For piano purchases, our standard white‑glove service includes delivery to your address and on‑site installation in the same appointment within our service zones. Fees and lead times are shown at checkout or quoted by our team. Surcharges may apply for stair carries (no lift), difficult access, remote locations, or specific time windows.
  • What installation includes. Unboxing, placement in your room of choice, assembly/setup (e.g., legs, lyre, pedals, music stand), bench setup, basic function checks, and removal of packaging. For digital pianos, we complete stand assembly and power‑on checks.
  • Access readiness. Please ensure safe, clear access (doorway measurements, stairs, lifts, loading bay bookings). If access is unsafe or the site is not ready, we may reschedule; re‑delivery/re‑installation fees may apply.
  • Risk of loss & title. Title passes to you when payment is received in full. Risk transfers after you (or your representative) sign the delivery/installation completion note.
  • Failed delivery. If delivery fails due to incorrect address or absence, re‑delivery fees may apply.
  • Self‑collection. Available for eligible small items; pianos generally require our delivery & installation service.
  • Post‑delivery (acoustic pianos). We recommend tuning after the instrument has acclimatised in your home (typically 2–4 weeks).

 

Returns, exchanges & refunds

Please read our Return & Refund Policy for full details. Key points:

  • Eligible reasons. We consider returns/exchanges where a product is faulty, damaged on arrival, incorrectly supplied, or otherwise covered by our policy or Malaysian consumer law.
  • Timeframe. Notify us within 7 days of delivery (or a reasonable time as stated in the detailed policy) to initiate a return/exchange.
  • Condition. Items must be returned in original condition with all accessories, packaging, and proof of purchase, unless the fault prevents this.
  • Non‑returnable items (examples). For hygiene/safety or special‑order reasons, certain items are not returnable, such as software, personal‑use items (earphones, harmonicas, instrument mouthpieces), oversized/overweight items, discontinued/clearance/used products, tubes, and speakers (unless faulty).
  • Process. Contact us before sending items back so we can provide instructions and an RMA, if applicable.
  • Refund method. Approved refunds will be processed to your original payment method (or store credit) within a reasonable time.
  • Unable to deliver. If we are unable to deliver and ship the goods to you, we may cancel the order and refund you in full.

 

Warranty

  • Manufacturer warranty. Products may come with a manufacturer’s warranty; terms vary by brand and model. Please refer to the warranty card/brand page for specific coverage and procedures.
  • Authorised service. Where required by the brand, warranty service (including piano tuning during the warranty period) must be performed by authorised service providers.
  • What is not covered. Wear‑and‑tear, misuse, unauthorised modification, moisture/heat damage, and damage from improper transport, moving, or installation are generally excluded.

 

Product information & availability

  • Colours & finishes. Due to lighting, screen settings, and natural material variations (wood grain/finish), actual products may differ slightly from images on the site.
  • Accuracy. We strive for accuracy but do not warrant that product descriptions, images, prices, or other content are error‑free. We may correct errors without prior notice and cancel any orders affected by material errors (with a refund if you have been charged).
  • Stock. Displayed availability is indicative and may change quickly.

Promotions, vouchers & gift cards

  • Promotional offers, discount codes, and gift cards are subject to their specific terms (e.g., validity period, brand or product exclusions, non‑transferability, non‑stacking with other offers). We may cancel or reject orders that do not meet promotional requirements.

 

Intellectual property

All site content—including images, illustrations, designs, icons, photographs, video clips, text, logos, and trademarks—is owned by or licensed to Le Musica and is protected by intellectual property laws. You may not copy, distribute, modify, or create derivative works from our content without written permission.

 

User content (reviews, comments & messages)

By submitting reviews, comments, or other content, you grant Le Musica a non‑exclusive, royalty‑free licence to use, reproduce, adapt, publish, and display such content in connection with the Services. Do not submit unlawful, abusive, defamatory, obscene, or infringing content. You are solely responsible for your submissions.

 

Third‑party links & services

Our site may include links to third‑party websites or services (e.g., payment gateways, social media). Accessing these is at your own risk. We are not responsible for their content, security, or practices. Please review their terms and policies.

Limitation of liability

To the fullest extent permitted by law, Le Musica will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill, arising from or related to your use of the Services or products purchased. Our total liability for any claim shall not exceed the amount you paid for the product giving rise to the claim.

 

Indemnity

You agree to defend, indemnify, and hold harmless Le Musica, its directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising out of your misuse of the Services, your breach of these Terms, or your violation of any law or third‑party rights.

 

Governing law & dispute resolution

These Terms are governed by the laws of Malaysia. Any dispute shall be subject to the exclusive jurisdiction of the courts of Malaysia (and, if you prefer, specify a venue such as Sarawak).

 

Termination

We may suspend or terminate your access to the Services at any time, with or without notice, if we reasonably believe you have breached these Terms or applicable law. You may stop using the Services at any time. Termination does not affect accrued rights and obligations.
